Justices of the Peace
What does a Justice of the Peace do?
A JP is authorised to witness and attest many documents such as:
- Statutory Declarations
- Affidavits
- Certify copies of original documents
- Witness the signing of Power of Attorney and Guardianship documents, providing the JP is satisfied with the capability of the signatory
- Waiver of Rights
- Search Warrants
- Drug Warrants
- Divorce documents
- Some JPs volunteer their time to sit in "Daily Rooms" in the Courts
to assist in the processing of court documents as well as being
available to the public for general witnessing duties.
JPs also attend many Libraries and Council Offices on a roster basis to make themselves more accessible to the public
There are no national Justices of the Peace in Australia. Each State and Territory has its own legislation to regulate the appointment and powers of Justices of the Peace. The functions of the office are different from State to State and witnessing requirements also differ from State to State.
Where can I find a Justice of the Peace ?
Some Libraries and Council Offices have JPs rostered at different times. An enquiry to your Council for the time of service is recommended. JPs are usually available at the metropolitan Magistrates Courts and the Family Court. Again, an enquiry about availability is recommended. Please remember:
